Lawyers for Whistleblower Law & Protected Disclosures

Senior legal counsel for individuals and advisers dealing with serious whistleblower & protected disclosure issues.

ABOUT WATSON Tax LAWYERS

Who We Are

Watson Tax Lawyers advises individuals, executives, professionals and employees dealing with whistleblower issues, protected disclosures and the legal and commercial consequences of reporting misconduct.

Whistleblower matters are rarely straightforward. They often involve serious personal, professional and financial risk, and a significant imbalance of power and information between the whistleblower and the organisation involved. The practice is built to provide careful, practical advice in that environment.

What We Do in Whistleblower Law & Protected Disclosures

01

Before Making a Disclosure

Advising individuals who are considering making a disclosure, but have not yet acted, on whether the matter may qualify as a protected disclosure, to whom the disclosure should be made, how it should be framed and what records should be preserved.

The objective is to help the client make informed decisions with a clear understanding of the legal and practical consequences before taking steps that may be difficult to reverse.

02

After a Disclosure Has Been Made

Acting for whistleblowers after a disclosure has already been made, including where there is concern about retaliation, isolation, loss of role, reputational harm, disciplinary action or other adverse treatment.

Work includes assessing the protections that may apply, dealing with the organisation and its advisers, and considering potential claims or settlement options.

03

Working with Lawyers Acting for Whistleblowers

Providing specialist support to lawyers who act for whistleblower clients and require input on protected disclosure issues, tax‑related disclosures, statutory protections, evidence strategy or the broader commercial context.

This is particularly useful where the existing lawyer remains closely involved, but the matter requires additional specialist insight into whistleblower law and related tax or commercial issues.

04

Tax‑Related & Corporate Misconduct Disclosures

Advising on disclosures involving tax, accounting, governance or corporate misconduct issues where both the underlying conduct and the whistleblower protections need to be considered together.

Anthony’s background as both a solicitor and chartered accountant is often valuable where the disclosure involves complex financial or tax arrangements.

05

Detriment Risk, Protections & Remedies

Assisting clients to understand the protections available against retaliation or other detrimental conduct, and the remedies that may be available if those protections are breached.

This includes advice on strategy, correspondence, potential claims and the interaction with regulators and other processes.

06

Interface With Regulators & Organisations

Acting as an intermediary between the client and organisations, regulators or other advisers, including preparing protected disclosures, managing correspondence and preserving legal professional privilege.

The aim is to ensure that the client’s position is protected as far as possible while the matter progresses.

HOW THE PROCESS WORKS

How the Process Works for Whistleblower Matters

01

Confidential Discussion & Context

We begin with a confidential discussion about what has happened, the organisation involved, the client’s role and what has already been done, if anything, so that the position is clearly understood.

02

Assessment of Protections & Risk

Anthony assesses whether whistleblower or protected disclosure regimes may apply, what protections they may offer, and what legal, employment, commercial or reputational risks are present.

03

Strategy, Documentation & Engagement

We design a strategy for how to proceed — whether that is making a disclosure, documenting concerns, dealing with the organisation, engaging with regulators or preparing for potential disputes — and assist with the necessary documentation and correspondence.

04

Ongoing Counsel & Resolution Pathways

As the matter progresses, Anthony remains involved as ongoing counsel, helping to navigate organisational responses, regulator involvement, retaliation risk and potential resolution or settlement pathways.
